A. Introduction & Scope

New Customers 365 (“NC365,” “we,” “us,” or “our”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard personal information when you visit our sites, use our applications, communicate with us, or access our services (collectively, the “Services”).

B. Roles (Controller/Processor)

  • Controller: For our websites, apps, billing, support, and our own marketing, NC365 determines the purposes and means of processing.
  • Processor/Service Provider: For customer content you upload into the platform (e.g., contacts, messages, call/SMS logs), NC365 processes data on your behalf to deliver the Services. A Data Processing Addendum (DPA) is available upon request.
This section aligns with the Terms of Service (§K).

C. Information We Collect

1) Personal Information (provided by you)
  • Identifiers and contact data (name, email, phone, address, company/role).
  • Account credentials and subscription information.
  • Payment-related details (tokenized via our payment processors; we do not store full card numbers).
  • Content you upload (contacts, messages, files, notes).
  • Support inquiries and communications.
2) Usage & Device Data (collected automatically)
  • Log data (IP address, browser, OS, device type, timestamps, pages viewed, interactions).
  • Diagnostics, analytics, and performance metrics.
  • Approximate location inferred from IP (where permitted).
3) Cookies/Pixels & Similar Technologies
  • Cookies, local storage, pixels, and SDKs to operate the site, remember preferences, measure performance, and (where applicable) our own marketing.

D. Sources of Information

  • You, when you create an account, provide content, or communicate with us.
  • Automatically via Services usage (see C.2–C.3).
  • Third parties (e.g., payment processors, communications carriers, analytics providers, or, if applicable, affiliates/white-label partners) consistent with this Policy.

E. How We Use Information

  • Provide, operate, secure, and improve the Services.
  • Set up and manage your account and subscription.
  • Process transactions and send service/transactional communications.
  • Offer support, troubleshoot, and respond to requests.
  • Measure performance and develop new features.
  • Comply with law, prevent fraud/abuse, and enforce agreements.
  • Send marketing communications where permitted (you can opt out at any time).

F. SMS/MMS & Communications

  • No mobile information will be shared with third parties/affiliates for marketing/promotional purposes.
  • Information sharing to subcontractors in support services (e.g., customer support) is permitted.
  • All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
  • Message frequency varies. Message and data rates may apply. Text STOP to opt out; text HELP for help. Consent is not a condition of purchase. Carriers are not liable for delayed or undelivered messages.
This section aligns with our Fair Use & Acceptable Use rules in the ToS (§I) and common 10DLC/CTIA disclosures.

G. Disclosure of Information

  • Service Providers/Processors: We share data with vendors that help us operate the Services (e.g., hosting, communications carriers, analytics, payment processing, customer support). They must use data only as instructed.
  • Affiliates/White-Label: If you subscribed via an affiliate/white-label partner, we may share limited account metadata for program administration (see ToS §J).
  • Legal & Safety: We may disclose information to comply with law, legal process, or lawful requests by authorities; to protect rights, safety, or the integrity of the Services; and to detect/prevent fraud, spam, or abuse.
  • Business Transfers: In a merger, acquisition, or asset sale, your information may be transferred subject to this Policy.

H. International Transfers

Your information may be processed in the United States and other jurisdictions, which may have different data protection laws than your region. Where required, we implement appropriate safeguards (e.g., standard contractual clauses) for cross-border transfers.

I. Data Retention

We retain personal information as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce agreements. After termination, we may delete data in accordance with our retention schedules unless law requires longer retention (ToS §K).

J. Security

We implement commercially reasonable administrative, technical, and physical safeguards to protect personal information. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

K. Your Privacy Choices & Rights

1) General Choices
  • Opt out of marketing emails via unsubscribe links or by contacting us.
  • Control cookies in your browser settings (see section M).
2) U.S. State Rights (e.g., CA, CO, CT, UT, VA)
  • Access, correction, deletion, and portability (subject to verification).
  • Sale/Share/Targeted Advertising: We do not sell or share personal information as defined by applicable law, nor engage in cross-context behavioral advertising with your personal information. If this changes, we will provide required notice and opt-out mechanisms.
  • Appeal a rights request decision (where applicable) by replying to our decision email.
3) EU/EEA/UK (GDPR)
  • Rights to access, rectify, erase, restrict or object to processing, and data portability.
  • Where processing is based on consent, you may withdraw consent at any time.
  • Legal bases may include performance of a contract, legitimate interests, consent, compliance with legal obligations, and protection of vital interests.
4) Exercising Your Rights

Submit requests at [email protected]. We will verify your identity and respond within the time required by law. Authorized agents may submit requests where permitted with appropriate proof.

L. Children’s Privacy

Our Services are not directed to children under 13 (or the age defined by local law). We do not knowingly collect personal information from children. If you believe a child has provided us information, contact us to request deletion.

M. Cookies & Tracking

We use necessary cookies to operate the Services and, where applicable, preference/performance cookies and limited analytics. You can control cookies through your browser settings. Blocking some cookies may impact functionality.

N. Do Not Track / Global Privacy Control

Your browser may offer “Do Not Track” signals, and some extensions send Global Privacy Control (GPC) signals. Our Services do not respond to DNT at this time. If we implement responses to GPC in the future, we will update this Policy.

O. Third-Party Links

The Services may link to third-party sites or services. Their privacy practices are governed by their own policies. We are not responsible for the content or privacy practices of third parties.

P. Changes to this Policy

We may update this Privacy Policy from time to time. Operational updates may be effective upon posting. If we make material changes, we will provide notice (e.g., email to your account address) consistent with our Terms of Service (§E) at least 30 days before the next renewal where the change is material to active subscriptions.
